Backside Birdshot

As we watch Ottawa get tougher on criminals in some aspects, and wait for them to clamp down in others, Singapore is bowing to international pressure.  If parliament agrees, drug couriers in Singapore will no longer get the mandatory death penalty if they help police.  Instead, judges will have the discretion to give couriers a life sentence, if they co-operate in a way that helps the investigation.  Singapore will keep the death penalty for drug bosses and distributors, saying tough penalties are needed to keep crime down.  Contrast this with the case of Brian Knight, the Alberta farmer who woke up to the sound of his all terrain vehicle being stolen.  He chased the thief, and with a shotgun, gave him taste of light birdshot in the butt.  I’ll pause here while you applaud.  Brian Knight was originally sentenced to 90 days to be served on week-ends.  The thief with the birdshot in the backside got only 30 days.  The Court of Appeal has now ruled 90 days was an unfit punishment for the farmer and, instead, gave him a suspended sentence.  I wonder what happens if you steal an ATV in Singapore.

    I can understand why the justice system got upset with Brians actions. Why, he may have just changed this criminals ways without him haveing to go to court three or four time to make a plea, plus the two or three time it would take for him to get a lawyer, plus the several time it would take to change lawyers, in order for a sentence of thirty days to be handed down. Now, due to the fact it costs the criminal nothing I would expect an appeal in due course. Naturally with the same ten plus days of billable hours for those in the "justice system".
    I mean really, if you lost twenty days pay for a judge, several lawyers, the admin staff, the guards etc. would you not get upset???
    Opps, I guess they got paid for both the criminal and Brian's trials in this case, well to those of you in the justice system I guess every cloud does have a siliver lining.

    Another fine example of our dysfunctional justice system. Brian had every right to protect his property. The criminal should have gotten a lot more. And I suppose this idiot will get away with suing Mr. Knight for the kick in the rear that he got as it probably slowed him down from all the other crimes he was going to commit. Sounds like that other idiot who stabbed a police dog and is now suing because the officer shot him. I'd like to know what low life is representing him in court? Quite clearly that lawyer wasn't brought up with a conscious either!

    Bob replies: Everyone is entitled to the best defence available. Calling the lawyer names solves nothing.

    When I was growing up back in the late fortys and early fiftys when a varmit came on the farm and caused trouble it usually wound up at the bottom of the manure pile and nothing was said. In my opinion it's to bad that that thief didn't just disappear too. It was a premier of this province that once said most farmers would have just shot it and buried it. He may have been refuring to mad cow disease but in this case you could say there was some mad thief that had to be dealt with.

    And therein lies the failure in our "in"justice system...Until this is corrected the criminals will just continue to laugh in our faces. How about if the thief was to have gotten 30 months,...and Mr. Brian,...a public letter of thanks and a free trip to the Bahamas to recuperate from his "trauma?"
    And just what did the lawyers fees for Mr. Brian cost and how much did this affect "his" families life? Justice System,...what an absolutely laughable terminology!!!

    When the judicial branch is made to respect everyone having rights, because otherwise we are on the road to a version of tyranny where those who do not have rights have a lower quality of life - we need to juggle more than that to have justice. Otherwise, we don't have justice.

      We all on this planet have EQUAL rights from the time of our conception David...but there are those who have a lower quality of life because of the tyranny of those who have placed themselves in some sort of unconstitutional or human rights authority OVER THEM!...like here in Canada!

    I hope you're not advocating sharia law as practiced in Singapore here in Canada because if you are ... your hero who illegally discharged the weapon (whether someone was injured or not) would be subject to a death sentence ...

    As a very young and quite stupid, Myself and a good buddy decided to steal some apples from an older ladies yard. As we were going over the fence after the deed, we were helped over by a shotgun blast of rock salt into our backsides. My buddy, Garys' dad was a animal vet and took great pleasure removeing the undisolved bits of rock salt out of our backside. Of course it did not help that Garys Dad and My Dad enjoyed our situation and at the end of the Iodine and swabs, a good swat with a belt ensure we would re-consider such a move in the future. We were both drafted into maintaining the lady's yard for the summer." she had the best looking yard in the area" Inspected of course by our dads. We actually came to care for the old lady and kept contact for years.....But I never stole another apple. The punishment fit the crime and a very valuable lesson was learned.....Is that not allowed anymore????

      @John In Edmonton Just a question John? What do you think would have happened if you had just knocked on the elderly woman's door and ASKED for some apples or offered to help her pick them? Bet you would have not only got some apples but would have enjoyed a nice hot apple pie with ice cream in the process!

      Too bad your Dad's didn't run for public office.....sounds like Canada would be a better place to live in than it is deteriorating to now!

    I hate thieves. The double crime is, that AFTER stealing from a member of the public, this low-life steal tax money from all of us to pay for his court and jail time. (Whether 30 days, 30 months, or 30 years.) The general public are still the ones being dealt the largest penalty. Especially in the case of thieves, I believe in teach them the value of work by making them work to pay for what they stole AND what it cost to bring them to justice. (The alternative is the three "S's" mentioned in an earlier comment, which feels kinda right too...)

    Your spot tonight reminded me of when my wife and I flew into Singapore a number of years ago.

    The customs declaration form handed out on the plane featured a small skull and crossbones reminding passengers that importation of drugs into singapore was punishable by death . At that late stage it must have made the customs officers job a bit easier in spotting the sweaty culprits on arrival!

    This case and the David Chen case shows that Canada needs to adopt something similar to "The Castle Doctrine" in the US. If someone comes onto your property and instigates an encounter, you should not be held accountable for what could be defensive fight or flight responses.
    First, the criminal should lose all rights to sue for anything or file for grievances. Second, if the government feels that the home owner acted in excess (and I'm talking killing or torture) then they could deal with it.

    Back in the day when I was a kid we did something bad we were punished for it we learnt from that. The problem is now a days no one is learning when they
    do something bad, there is no punishement that is why there is no respect for anything these days. I wish the common people were allowed to propect their property and discipline their children.
