The long, winding road that is the Travis Vader case continues.
Justice Denny Thomas announced this morning that he intends to decide on the mistrial application on October 31st.
In the weeks leading up to that, the Crown and Defence will exchange written submissions and deliver them to Justice Thomas by October 19th.
The main point of contention from the Defence, is Thomas’ use of an unconstitutional section of the criminal code when he handed down the verdict. Vader was convicted of second-degree murder in the deaths of Lyle and Marie McCann.
The mistrial application decision is expected to be read in open court. (bw)
